In this document, ABDALLA SULEIMAN SIJAM and his personal brand SIJAM SLEIMAN are jointly referred to as the “Company”.

These Terms and Conditions govern access to, use of, and purchases made through the Website by any user or customer (hereinafter, the “User”).


2. ACCEPTANCE OF THE TERMS AND CONDITIONS

By accessing, browsing or using the Website, the User acknowledges that they have read, understood and accepted these Terms and Conditions, as well as the Company’s Personal Data Processing Policy and Cookie Policy.

If the User does not agree with these Terms and Conditions, they must refrain from using the Website.

The Company reserves the right to update or modify these Terms and Conditions at any time. Modifications will take effect from the date of their publication on the Website. Continued use of the Website after the changes have been published implies acceptance of such changes.


3. USER REGISTRATION AND ACCURACY OF INFORMATION

To make purchases on the Website, the User may either register by creating an account or make purchases as a guest, depending on the functionalities available.

The User agrees to:

  • Provide true, accurate, current and complete information.

  • Keep their account information and contact details up to date.

  • Carefully safeguard their login credentials (username and password) and not share them with third parties.

The Company shall not be liable for any misuse of the User’s credentials by the User or by third parties to whom the User has provided such credentials.


4. PRODUCTS, AVAILABILITY AND INFORMATION

4.1. Product description

The Company mainly offers fashion products, clothing and accessories. The essential characteristics of each product (materials, sizes, colors, care instructions, etc.) are described on the corresponding product page on the Website.

Product images are for reference only. Although the Company seeks to ensure that they accurately represent the actual product, slight variations in color or texture may occur due to lighting conditions, photo editing or the settings of the User’s device screen.

4.2. Availability

Product availability is subject to the stock on hand. The Company strives to keep information up to date, but in exceptional cases a product may be unavailable after an order has been placed. In such cases, the Company will inform the User and may offer:

  • An exchange for another product of similar value;

  • A store credit / voucher in favor of the User; or

  • A refund of the amount paid for the unavailable product.

4.3. Prices

Product prices are expressed in Colombian pesos (COP) and include applicable taxes, unless expressly stated otherwise.

Before finalizing the purchase, the User will see the total amount to be paid, including taxes, shipping costs and any other additional applicable charges.

The Company reserves the right to modify prices at any time; however, such changes will not affect purchase orders that have already been confirmed.


5. PURCHASE PROCESS ON THE WEBSITE

The general purchase process on the Website is as follows:

  1. The User selects the product(s) they wish to buy and adds them to the shopping cart.

  2. The User reviews the selected products, sizes, quantities and prices.

  3. The User enters the required shipping and billing information.

  4. The User selects one of the available payment methods.

  5. The User confirms their intention to purchase and proceeds to payment through the selected payment gateway or method.

  6. Once payment is approved by the financial institution or payment provider, the Website generates an order confirmation and the Company begins preparing and shipping the order.

The purchase order is considered completed when:

  • The User has filled in the data form and confirmed the order; and

  • Payment has been approved by the corresponding payment method.

If payment is rejected or not confirmed, the Company will not be obliged to hold product availability nor to dispatch the order.


6. PAYMENT METHODS

To make purchases on the Website, the User may use the following payment methods:

6.1. BOLD payment gateway

Through BOLD, the User may pay using, among other options:

  • Credit and debit cards from the brands accepted by the gateway;

  • Payments from bank accounts and other electronic methods enabled by BOLD.

The administration of financial information and payment method data is carried out directly by BOLD, under its own terms and conditions and privacy policies. The Company does not store and does not have access to full credit or debit card numbers, PINs, or any other sensitive payment data.

6.2. ADDI (installment credit)

The User may choose to pay for their purchase through the installment credit service offered by Addi, subject to the policies, credit assessment, rates, terms and conditions independently established by that entity.

By selecting Addi as a payment method, the User acknowledges that:

  • The credit relationship is established directly between the User and Addi.

  • Approval, rejection, terms, interest rates, fees and all other credit conditions are determined by Addi, without intervention by the Company.

  • The Company receives payment for the purchase only once Addi has approved and processed the transaction.

6.3. General payment conditions

Payment confirmation is subject to:

  • Authorization by the financial institution or payment method provider; and

  • Fraud prevention checks that may be carried out by the Company, BOLD, Addi or the involved banks.

If payment is rejected for any reason attributable to the payment method or financial institution, the purchase order will not be considered completed and the Company will not be required to ship the order.


7. SHIPPING AND DELIVERY

7.1. National coverage

The Company currently ships throughout Colombia through partner courier companies, such as:

  • Interrapidísimo

  • Envía

  • Deprisa

  • Servientrega

The Company may, based on cost, time and coverage criteria, select the most appropriate carrier for each order. In some cases, the User may choose a preferred carrier among the options available at the time of purchase.

7.2. Delivery times

Estimated delivery times are counted from payment confirmation and may vary depending on the destination city or area, selected carrier, weather conditions, public order situations or other circumstances beyond the Company’s control.

In general, estimated delivery times are:

  • Main cities: between 2 and 5 business days.

  • Other cities and rural or hard-to-reach areas: between 5 and 10 business days.

These time frames are estimates and do not constitute a guarantee of exact delivery dates. Any delay will be managed together with the carrier, and the User will be informed where possible.

7.3. Shipping costs

The shipping cost will be informed to the User before completing the purchase and may vary depending on:

  • Destination city or area;

  • Package weight and volume;

  • Selected carrier.

In some cases, the Company may offer free shipping subject to conditions (for example, orders over a certain amount, promotional campaigns, etc.), which will be communicated on the Website.

7.4. Risk of loss or damage

Once the product has been handed over to the carrier, the risk of loss or damage passes to the User, without prejudice to any claims that the Company and the User may file against the carrier, and without affecting applicable consumer warranty, exchange and return policies.

If the package is delivered opened, damaged or with signs of tampering, the User is advised to immediately record this with the carrier (on the waybill, reports, photos) and report the incident to the Company within a reasonable time so that the situation can be assessed.

7.5. International shipping

The Company is interested in enabling international shipping to certain countries outside Colombia. When this option becomes available, the Website will provide clear information about:

  • Countries and destination cities covered;

  • Estimated delivery times;

  • Shipping costs and possible additional customs, tax or duty charges;

  • The respective responsibilities of the Company and the User regarding customs procedures.

As long as the international shipping option does not appear as available during the checkout process, it shall be understood that the Company only ships within Colombia.


8. EXCHANGES, RETURNS AND WARRANTIES

8.1. Voluntary exchanges

In addition to statutory warranties, the Company may offer the User the possibility of voluntary exchanges (for example, for size or color) under the following general conditions:

  • The maximum period to request an exchange will be {{X}} calendar days from the date of delivery of the product.

  • The product must be in perfect condition, with no signs of use, washing or alterations, and must retain its original tags, labels and packaging.

  • The User must provide the invoice or proof of purchase.

  • Unless otherwise indicated on the Website or in special promotional campaigns, shipping costs related to voluntary exchanges will be borne by the User.

The Company may establish categories of products with no exchange, for hygiene or safety reasons (for example, underwear, bodysuits, swimwear or others expressly indicated before purchase). Such products will be identified as “NO EXCHANGE” on the product page or in the exchange policy.

8.2. Legal warranty

The Company is responsible for the quality, fitness and safety of the products it sells, in accordance with Colombian consumer protection regulations.

If a product presents quality defects attributable to manufacturing or materials, the User may file a claim within the applicable warranty period, providing evidence of the defect (photos, description, etc.).

Depending on the case and the evaluation carried out, the Company may offer one of the following solutions:

  • Repair of the product (if applicable);

  • Replacement with an identical or similar product; or

  • Refund of the amount paid for the defective product.

Quality issues arising from improper use, lack of care, washing in conditions different from those indicated on the label, or normal wear and tear due to use will not be considered warranty defects.

8.3. Right of withdrawal

When the purchase is made through the Website as a distance sale, and provided that the products are of a type for which the law allows withdrawal, the User may exercise the right of withdrawal within five (5) business days following delivery of the product.

To exercise this right, the User must:

  • Notify the Company of their decision within the indicated period using the official contact channels;

  • Return the product in the same condition in which it was received, unused, with original tags and packaging.

Unless the Company states otherwise, shipping costs associated with returning the product due to withdrawal will be borne by the User.

Once the right of withdrawal has been correctly exercised and the product returned, the Company will have a maximum period of thirty (30) calendar days to refund the amounts paid by the User, in accordance with the law.

The right of withdrawal does not apply to products made according to the User’s specifications or clearly personalized, nor to products for which Colombian law excludes this right.

8.4. Reversal of payment

When products are purchased through electronic commerce using credit cards, debit cards or any other electronic payment instrument, the User may request reversal of payment in the cases and under the terms provided by Colombian law, including:

  • Fraud;

  • Unauthorized transaction;

  • Non-receipt of the product;

  • Defective product or product not corresponding to the order.

The request for reversal must be submitted within the deadlines and in accordance with the requirements established by law and by the relevant financial institution or payment gateway. The Company will cooperate with the process to the extent of its responsibilities.


9. INTELLECTUAL PROPERTY

All content on the Website—including, but not limited to, texts, images, photographs, designs, logos, trademarks, graphics, videos and source code—is owned by the Company or used with authorization from the rights holders and is protected by applicable intellectual property laws.

Reproduction, distribution, public communication, transformation or any other unauthorized use of such content is prohibited, unless prior express authorization is obtained from the Company or the respective rights holder.

Use of the Website by the User does not grant any intellectual property rights over the content made available on it.


10. PROPER USE OF THE WEBSITE

The User agrees to use the Website lawfully and appropriately, and specifically undertakes not to:

  • Use the Website for illegal activities or activities contrary to good faith or public order;

  • Attempt to gain unauthorized access to restricted areas, IT systems or data of other users;

  • Introduce or spread computer viruses or any other physical or logical systems that may cause damage to the Company’s or third parties’ systems;

  • Use the Website’s content for unauthorized commercial purposes.

The Company reserves the right to restrict or block access to the Website for Users who breach these Terms and Conditions.


11. PERSONAL DATA PROCESSING AND COOKIES

The processing of personal data collected through the Website or in the context of the Company’s commercial activities is governed by the Personal Data Processing Policy, available on the Website.

The use of cookies and similar technologies on the Website is described in the Cookie Policy, also available on the Website.

By using the Website, the User acknowledges and accepts these policies.

13. APPLICABLE LAW AND JURISDICTION

These Terms and Conditions are governed by the laws of the Republic of Colombia.

Any dispute arising from the use of the Website or purchases made through it, which cannot be resolved directly between the Company and the User, shall be submitted to the jurisdiction of the courts of the Republic of Colombia, without prejudice to consumer protection mechanisms before the Superintendence of Industry and Commerce or other competent authorities.
